Milwaukee / Wauwatosa — A judge ruled this week that a 15-year-old suspect charged in the April 14 fatal shooting of David Krause will be tried as an adult, meaning two of the three teens accused in the case will now face adult court.
The latest waiver hearing outcome brings the number of defendants heading to adult court to two. Krause, 35, was shot and killed in an alley in Milwaukee’s Walker’s Point neighborhood after asking a group of teens for a ride during severe storms while celebrating 414 Day. Investigators have described the incident as an attempted robbery; the vehicle involved was later set on fire.
Current Status of the Defendants
- Breontae M. Tyler, 16: Previously waived to adult court in July. He was formally charged as an adult on July 30 with felony murder, operating a vehicle without the owner’s consent, and arson of property other than a building (Milwaukee County Case 2026CF003608). On August 10, a judge found probable cause and bound him over for trial after he pleaded not guilty. He is due back in court on September 9; a trial date has not yet been set.
- 15-year-old suspect: Ruled this week to face adult court. Formal charges are still pending, so the teen cannot yet be publicly identified.
- One 16-year-old: Previously denied waiver and will remain in the juvenile system. That teen cannot be named.
The Krause family has attended numerous hearings and continued to call for accountability, expressing frustration with aspects of the juvenile justice process involving defendants with prior records.
